Bluenext S.r.l (hereinafter also referred to as "Bluenext") aims to provide all the information necessary to ensure safe browsing within its website. Therefore, in order to protect the privacy rights of users of the website accessible at https://www.adiuto.it/, Bluenext sets out in this document its privacy policy, so as to provide all the information necessary regarding the collection, management and storage of personal data collected online.
We therefore invite you to read this document.

Access to and browsing of the website is free for all users, while some of the services provided by Bluenext may only be used by registered users; in this regard, the user, during the registration process, undertakes to provide their personal data in an accurate and up-to-date manner. In the event that the user makes use of the services on behalf of third parties, Bluenext acts as an independent data controller for the personal data of such individuals. In this respect, the user undertakes to indemnify and hold Bluenext harmless from any claim, dispute, or request for compensation for damages arising from data processing that may be brought against Bluenext by the individuals whose personal data is concerned.

2. Subject of processing

The Controller may process:

  • Personal identification data (for example: first name, last name, nationality, province and municipality of residence, company name, tax code, address, landline and mobile phone number, fax, e-mail, banking details …),
  • Banking data (IBAN and bank and postal details, with the exception of credit card numbers);
  • Telematic traffic data: including information recorded by Bluenext's computer systems during the normal provision of its services (e.g., information related to internet communication protocols, cookies, IP addresses, access logs to computer systems) and within the provision of the email service, any data processed for the purpose of transmitting a communication, including data necessary to identify the user.
  • Data voluntarily provided by the User: the user, during the registration process, while using the services, or through the "work with us" section, where available on our domains, voluntarily provides their personal data upon completing the procedure.
  • Third-party data voluntarily provided by the User: the user may use Bluenext's services on behalf of third parties who do not have a direct relationship with Bluenext.
  • Registration data to become a Bluenext partner (if applicable): through the "become a partner" section, Bluenext collects personal data of individuals from businesses applying.
  • Cookies are small text files that the sites visited by users send to their terminals, where they are stored to be transmitted to the same sites on subsequent visits. Cookies are used for various purposes, have different characteristics, and can be used by both the owner of the site being visited and third parties. More information can be obtained by consulting the cookie banner present at each access to the site and expressing consent to data processing; specific information is recommended for reading. Consents can be modified at any time directly from the same banner.

3. Purposes of data processing and legal basis for processing

All data processing operations are implemented to guarantee the integrity, confidentiality, and availability of personal data.

Any special data contained in CVs will be processed on the basis of the necessity to fulfil contractual obligations arising from the employment relationship of a remuneration, social security, tax and insurance nature. – Art. 9(2)(b) GDPR.
Identification data and data contained in the attached CVs. The provision of data is optional. Users are not obliged to apply for available positions and provide their data; however, the provision becomes mandatory once the data is communicated to us in order to manage the application.

4. Methods of processing

Personal data may be processed both through paper archives and magnetic, electronic or telematic media and processed in ways strictly necessary to meet the purposes specified in the privacy policy and indicated above, and in any case in a way that guarantees the security and confidentiality of the data itself..

5. Consequences of failure to provide personal data

For the purposes referred to in point 3, numbers 1, 2, 3 and 5, the provision of data is necessary to fulfil the relevant contractual obligations and to comply with the legal obligations connected thereto.
Users and visitors to the website are free to provide or not provide their personal data: failure to do so may result solely in the inability to obtain what has been requested.
The provision of personal data is necessary to register and to be able to make purchases on the Company's website or of the product, to receive and install software updates. In particular, the provision of data present in fields marked with an asterisk is mandatory and their failure to enter doesn't allow the registration procedure to be completed. The release of data present in fields not marked with an asterisk, while useful for facilitating relationships with us, is optional and the lack of indication doesn't prejudice the completion of the procedure.
For the purposes indicated in point 3, number 4, the provision of data is not mandatory.
For the purpose indicated in point 3, number 6, the provision of data is not mandatory; however, processing will be necessary should you decide to voluntarily provide your data.
For the purpose indicated in point 3, number 7, the provision of data is necessary to enable us to fulfil the legal obligations to which we are subject.

6. Data retention

Personal data, subject to processing for the purposes indicated above, will be retained for the duration of the contract and, subsequently, for the time in which the undersigned company is subject to retention obligations for tax purposes or for other purposes, provided for by laws or regulations.
Personal data, subject to processing for the purposes indicated above, may also be retained for future commercial purposes. In the case of data provided for marketing and profiling purposes will be retained for a period of time not exceeding what is strictly necessary to achieve the indicated purposes.
Data is also processed by Bluenext for ordinary business processing related to service provision (e.g.: for documentation purposes in case of invoice disputes or payment claims, for fraud detection, to perform analysis on behalf of clients), by virtue of what is provided by regulations. In this case, data is retained with stringent security measures applied in accordance with the law and subsequently deleted.

7. Data communication

Your personal data may be communicated to:
  1. Collaborators, employees, consultants, suppliers for the provision of services related to the requested service, including those belonging to other companies of the Bluenext Group;
  2. Accountants, legal professionals, or debt collection companies that provide services functional to the purposes indicated above;
  3. Financial, digital payment banking, and insurance institutions that provide services functional to the purposes indicated above;
  4. Financial administration, Public Entities, Judicial and Supervisory Authorities for compliance with legal obligations and defense of rights.
  5. To third parties (e.g., payroll processing companies, credit institutions, professional firms, consultants, etc.) that perform outsourcing activities on behalf of the Data Controller, in their capacity as external data processors, the list of which is available at our headquarters.

Third-party suppliers and/or Bluenext's data processors adopt security measures to ensure compliance with current legislation on personal data protection.

8. Personal data transfer

The Controller will not transfer data to a third country, unless it's necessary for the execution of the contract and provided that appropriate and suitable guarantees exist.
Personal data may be transferred to non-EU countries for which an adequacy decision by the European Commission exists, pursuant to Art. 44 and following of Regulation (EU) 2016/679.

9. Profiling and Data dissemination

Your personal data is not subject to dissemination, however, in the context of data processing for marketing purposes, the Controller uses automated processes also aimed at profiling exclusively in the case where the interested party has provided explicit consent, revocable at any time.

10. Use of Social Media

Bluenext is present on various social media platforms, such as Facebook and LinkedIn.
When visiting the Company's pages on the social media mentioned above or others, they collect, as independent Controllers, users' personal data, e.g. through cookies. Such collection may occur even if you have not logged in to the same. Information regarding data collection and further processing by the social media used is available in their respective privacy policies which, therefore, are not attributable to Bluenext.
Bluenext does not obtain full access to such collected data or to any user profile but can only access information from their "public" profile. Information shared by the user as "public" can be modified by them through their personal settings.
Bluenext uses the personal data of users who decide to contact the Company through social media channels to respond to their questions. Bluenext receives anonymous statistics based on legitimate interest on the use of its pages from the social media used. The following anonymous information may be provided, for example:

  • Followers: the number of people following Bluenext – including growth and development over a defined time period;
  • Reach: number of people who see a specific content;
  • Number of interactions on a post. For example, it is possible to deduce which content is better than others in the community.
  • Advertising performance: how many people have seen an ad or article or interacted with it;
  • Demographics: average age of visitors, gender, place of residence, language.

These statistics are used to constantly improve online content and to better respond to the interests of our users. Bluenext cannot link statistical data with fan profiles or individual users.
Our site also features so-called Social Plugins. These are buttons that allow content sharing on social media platforms. Should a user decide to share certain content, some of their internet traffic data could be shared with such third-party platforms in a manner consistent with the purposes and means indicated by the privacy policies of the platforms to which the plugins refer. 11. Rights of the data subject

Among the rights recognized to You by the GDPR are those to:

  1. Request to this company access to your personal data and related information; the rectification of inaccurate data or the integration of incomplete data; the deletion of personal data (upon the occurrence of one of the conditions indicated in Article 17, paragraph 1 of the GDPR and in compliance with the exceptions provided in paragraph 3 of the same article); the restriction of the processing of your personal data (upon the occurrence of one of the cases indicated in Article 18, paragraph 1 of the GDPR);
  2. Request and obtain from this company - in cases where the legal basis for processing is the contract or consent, and the same is carried out by automated means - your personal data in a structured and machine-readable format, also for the purpose of transmitting such data to another data controller (so-called right to data portability);
  3. Object at any time to the processing of your personal data in the occurrence of particular situations;
  4. Revoke consent at any time, limited to cases where processing is based on your consent for one or more specific purposes and concerns common personal data (e.g., date and place of birth or place of residence) or particular categories of data. Processing based on consent and carried out prior to its revocation retains its lawfulness;
